My spouse (Indian citizen) has received an RFE for her derivative I485 application.
Her birth certificate has a different first name than her passport. We had filed the birth certificate and an affidavit from her parents attesting to the change. But that doesn't seem to be sufficient.
The RFE states:
"Your birth certificate indicates that your first name is XXX and not YYY. Please explain and submit additional documentation in support of your claim".
...
"Copies of the personal pages in your passport OR affidavits are not sufficient to establish a legal name change. Court documents submitted as evidence of name change must have been registered with the proper civil authority".
We now plan to submit the following:
1. Court Affidavit filed by my spouse's father at that time of legal name change, at age 3. This affidavit was before a Sessions Judge in India. This was the legal process of changing her name at that time.
Will this be sufficient? We don't understand what it means for a court document to be registered with the proper civil authority. Can you please advice?
2. My spouse has a Certificate of Age, Domicile and Nationality issued by the State Goverment of Maharashtra that refers to the new first name and also refers to the birth certificate as well, as proof.
Will that count as sufficient "registration with civil authority"?
I would appreciate if someone who has gone through this issue would comment on the proper ways of addressing this.

Hi Antonio, I have the 70-210 AF (non-D). It's from the first generation of Nikkor AF lenses. I've also got the 18-70. The focus on the 70-210 is pretty sluggish. It can't keep up to fast moving targets, at least w/ the D80 (I've heard the D200 has a better focus motor -- this lens uses the old in-camera focus motor rather than the newer/quieter in-lens focus mechanism). I've shot some sports with this lens, and it's fine when you can pre-focus on a spot, or when the action is moving perpendicular to you (rather than towards/away) -- it can keep up. If you can live with these limitations, then the lens will work for you. I can't really comment on how the 70-210 AF-D works, though I've read the same thing, that it's geared for faster focus.

Hi,
Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

Family 4th preference is retrogressed by a decade ( or two if you are from Philippines), so you may have to wait another 10 years to be eligible to file i-485.:confused:

Notice Date is the date they generate the receipt
We are interested in the former (so it happens to be July 2nd in your case)
Wait for your receipt and confirm that the "Receipt Date" printed on your receipt is July 2 (99% of the cases have the date CIS physically received the package)

EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

I dont know your exact visa background, but why do you want to use EAD, it is always better to stay on h1, if you are planning to shift employer then do h1 transfer. There are lots of threads explaining the pros and cons of using AC21 and switchin to EAD etc... but the safest way is to stay on h1.
If you can then i would suggest staying on h1, if you are shiftin employer talk to new one to ask for h1 transfer...

Found the old J1 Visa stamped in the passport. It does list the 212(e) requirement.
At the time when I got the first H1, I had 2 years, or close to 2 years of accrued stay in Russia. I should definitely have 2 years by now.
What could be the result of not having had full 2 years at the time of first H1? What could be the effect on the currently active H1?
If I show that right now I have 2 full years, would the AOS proceed, or are there any retroactive problems?

I'm seeking second opinion for my situation.
My H1b visa has been extended for another 3yrs and my current stamped visa expires sept 2010. I work for a typical consulting company with a client at end and a vendor in the middle. I've a clean record and have been paid always for last 3yrs, without a single month gap.
I'm visiting India in June for marriage so I wanted to go for the stamping as well. I've a situation where I'm looking for a second opinion.
What would you do if you were in my situation:
1. Go for visa stamping alone immediately after landing in India before marriage. Marriage is about 8-9 days after I land there. And, my spouse can go for H4 visa alone after marriage once marriage certificate is ready.
2. Go for visa stamping after marriage with spouse as well. But I'll have only 7-8 business days based on the latest dates available after marriage.
3. Don't go for stamping as I can return with a valid visa and I-797. My spouse can go alone after.
I'm tending towards #2 just because if I do get stuck for some reason, I doubt they will process my application within 2-3 weeks without needing to alter the travel plan when I go with #1. So, either #1 or #2, if I've a situation in stamping then I doubt anything will get settled just in 2-3 weeks.
I want to go with my wife just because I'll have one less work to get done and we can plan her transition from existing job.
What will you do given same situation? Any risk that you see?

No, you do not need to file I485 for child, who is a us citizen. No medicals exam required, since they get everything here after birth.
But you have to mention child details on your I485.
I recently filed mine.

I agree. Please use proper legal advise. Also see if youo can do a permium processing for I140 as it may be helpful to have a approved 140 for H1B extension and priority date retention.
