I have filed 485 for all my family members and received the EAD and AP(s). FP is not done yet. My daughter is in 1st year undergrad. Is there a way my daughter's 485 status can be maintained, if I join my daughter for MBBS study in India? If yes, what would be the option. Apreciate the suggestion

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. Third, the employer must normally require a degree or equivalent; or the nature of the specific duties is so specialized and complex that knowledge required to perform the duties is usually associated with attainment of the degree.
Individuals with H-1B visas are allowed to work in the United States for up to six years, but visas are granted in three-year increments. In some cases, the H-1B visas may be extended for more than six years. If the individual is in the United States, a change of status to an H-1B is filed in the United States. If the individual is outside the United States, upon approval of the petition, the individual must apply for an H-1B visa at the U.S. consulate. There are only 65,000 H-1B visas issued per year.
The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.
It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. As of August 7, 2009, approximately 44,900 H-1B cap-subject petitions had been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the cap. Hello everyone
My GC is during I-140 step as EB2 category with A company.
Currently, My company A is working on reorgnization. I am not clear which term I can use to descrip this changes:
Please reviwe the steps below:
1. currently company A will setup a wholly subdivison as B (LLC);
2. Company A will contribute its buiness and all assets to B for exchange 100% member shares before closing dates;
3. Investor C purchase 55% member shares of B on the date of closing this deal.
A company will be remain exit after closing, but it is only tax shell for the owner, it will be prohibit to do any similar business in the future, B get A's original buiess and all assets.
If anyone have similar situation before, and can give me some advisor on how to file the docuementation to show B is"Successor in interest" of A after closing deal.

Why isn't IV a national member of the Reform Immigration for America Campaign? If you take a look at the list of participating organizations Organizations � Reform Immigration For America (http://reformimmigrationforamerica.org/about/organizations/) you'll only see that the TX state chapter has signed on. Core group, could one of you take a look and sign-up? Would IV consider cooridnating events with them during 2010?
I saw the list and all organizations want to give citizenship to undocumented. We are all documented.

Before starting the application process for permanent immigration, foreign nationals who enter the United States on non-immigrant visas (NIV) are considered to be here temporarily. The law presumes NIV holders intend to return to their home countries at the end of their stay in the United States. There are many NIV categories — student visas, business visas, visas for tourism, and investor treaty visas to name a few. While NIV applicants must have the intent to return to their home country, there are a few non-immigrant categories that allow a person to have dual intent, that is, to intend to be here temporarily now but eventually to immigrate. Hello,
I am working with A on h1b and the visa expires on May 1st 2010.
Recently I got another offer with B and they filed my h1b transfer (regular).
The offer they gave me verbally is different from what's on the offer letter, when I contacted them there insist that they never "promised" , so I did not want to take that offer now.
Can I now ask employer A to file the extension and continue working with A?. Will that create any issues if the transfer with B gets Approved/rejected?. or is there any alternate?. Please help.

There is nothing like H1 transfer. Each petition is separate. Company B filing H1 does not invalidate your H1 from Company A. Your original H1 will still be valid even if H1 from company B is approved/denied. You can just continue working with company A and file extension when its due...

I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....

Yeah, the horizontal shot had no sky that wasn't gray - I took many. Also the left side of the bridge has some maintenance going on and looks awful (tarps & scaffolds). I'll work it over some more in PS. Thanks for the feedback :)

My LCA appl has a priority date of June 2004; and so far, Dallas BEC has lost my resent-appl twice. Lawyers failed to retrieve any status after that, and suggested a congressional liaison enquiry into it. If anybody is aware of this enquiry, would you plz let me know? Thanx.

Did you get the finger Print Notice?
My case was also transeferred from NSC to CSC and then back to NSC. I got the receipt and tranfer notice but no finger print notice yet.

Hi Kirupa. That would be an interesting example to see. It would allow the user to take advantage of the "image-in-image" aspect of Deep Zoom, while still being able to filter on-demand if needed.
