I am also interested in this topic. My wife is working curently using OPT. But, she is waiting for EAD also. So, once 485 EAD comes, she will be in similar situation.
Lawyer has suggested using 485 EAD once it comes.
Anyway, for travelling, AP has to be used. Once you travel on AP and come back, you cannot continue working using OPT. You have to use 485 EAD. So, it is better to switch to 485 EAD to avoid confusion.
I am planning to keep her on OPT till Dec 31. It will make our tax filing easier next year. From January, she can switch to 485 EAD and pay social security tax.
Let me know if you can some concrete info on this.

Thank you !This whole thing has cost me a lot.I had to cancel the airtickets,the travel agent charged 300.00/ticket. $1500.00.I am sitting at home for 3 weeks as the vacation is not cancelled,as I can't carry it over to next year,per employer's policy.I wished I could finally go home first time,after 6 years in the US,now that is not happening anytime soon.

So even though I feel a lot weight off my chest as you do, it still rankles, as I was always on top of these things and even offered the attorney to be there on September 30,2005, and was willing to fly to Vermont even at the last moment, but he could not keep those packages ready to hand it to FedeEx. He did not faul to collect the fee for his NON-service anyway.

Smerchas...Are you sure about what this? From what I remember, you have to be in the country when you apply for your AP...But there is no necessity that you need to be here when it is approved !
Technically, you can ask your attorney or the person who is living at the address where the AP document would be sent by the USCIS, and request them to forward the approved AP to your then current address...That way, you don't have to stay in the country while USCIS processes your application...
Ofcourse, the flip side is, if your AP is denied for any reason, you would have to go to the US consulate in wherever country you are and request the special admission letter...

I think "Advance Parole" means just that, you have to have it in Advance of leaving the country for it to have any meaning. Hi, continuing the same line of discussion, I have a slightly different question. Assuming the insurance company does not reimburse us for 485 medical exams, then can we atleast seek tax rebate on this expenditure? In other words, are the medical expenses incurred for 485 filing deductible at the time of tax filing?

if the principal files 485 now and then gets married say 2-3 months later when the dates are NOT current, can a dependent 485 be filed for the spouse so that she can get EAD?
I was told that even in the case of a dependent 485 filing, the dates have to be current for the application to be accepted :(
On related lines, if the principal application gets EAD and after 6 months moves to a new job based on EAD, and then he gets married, can he bring his spouse on H4? I think the answer is NO.

If your PD is in May'06 or early Jun'06, I think paying a visit to USCIS center won't hurt. Checking online status is a waste of time. At least you'll know what's going on with it. The IO I went to was very nice lady and gave me all the details. I thought that there would a line of GC aspirants like me :) waiting in USCIS center (in bay area) but to my surprise it was empty! Hope this helps

It's actually a myth that a longer lens requires a higher aperture. For the same framing, you get the same DOF (Depth Of Field) for the same aperture, whether you use a 600mm telephoto lens or a 4.5mm ultra-fisheye. - Mats
You are technically correct of course, but for practical purposes, if Shannon's primary goal is trying to capture a good depth of field of a child running around, and based on Shannon's comment about the willingness to crop, DOF will be easier to achieve with a wider lens.
Having said that, it was good for you to provide the rest of the story as it may be the basis of decisioning as the skills improve.

My H1 was approved in 2007 quota and i entered US in march 2008..but was not successful in getting a job and my employer is not running any payroll..

I just wanted to get some input from the veterans here who have started a business in partnership while they have been waiting for the coveted green card.
What kind of legal paperwork does it take to start a business? I would think as long as you don't work for the business it should be ok? If you can own part of a corporation (stocks), you can be a partner in a business?
Ideas?
If you are in H1B status, you can start your business by investing, but not working. You can not work for your business to get paid, but you can get profit sharing. In Wisconsin, when you register, you need a President/CEO who can legally work for your business. You can check with your state and register your business there. Probably, you even can register online in some state. Of cause, later on, you will need help from your accountant, laywer, etc.
If you have Green Card or EAD, that is not a problem to run by yourself.

Before coming to EAD, she travelled abrod and got I-94 till Sep-2010.
My Question is: Does she needs to get new I-94 after Sep-2010. I believe if she goes out of country she gets I-94 when travelling with AP...is this correct?? Can someone please tell me necessary steps to take care to maintain status when on EAD.

If USCIS receives both the applications, it will return the second application as a duplicate. I don't kow if they keep the money though ...

We applied for her AP renewal on July 1st 2009 and on the status page, it says approval notice sent on July 16th. At the same time I also see a soft LUD on her I-485. The new date is 07/15/2009 but no status update. Are these two events connected or is someone actually looking at her I-485? Note, she is not current per priority date, however Texas processing times have been updated recently.

Establishing that one has had "five years of progressively responsible experience" is really more of an art than a science. Small details in wording or in context can sometimes be critical in painting an overall picture.
Remember that the USCIS adjudicator is not likely to be as tech savy as you are. While you may know that WXY technology is the same as, or includes XYZ technology, don't assume that the adjudicator will. Make sure everything is explained and documeted in easily understood layman's terms.
Similarly, if you worked for a small firm as a "Senior Systems Analyst" and then moved to a more responsible/demandining position in a larger firm where your title was "Systems Analyst", provide a clear and well documented explanation as to why the move represents represents career progress despite the lesser job title.
Whether or not to include your Certificates is a judgment call that can only be made after reviewing all of the experience documents in relation to the specific PERM requirements.

The 60 rule is a senate rule and only makes the status quo folks happy.
You cannot get anything done with 60 votes. California has the same problem with the budget requiring 66% votes.
BTW, if you are a republican the reason that the Bush tax cuts are going to expire next year is that they were passed via reconciliation. So I am going to be paying more taxes next year.
I will be paying more taxes if Healthcare reform passes too, but I still oppose the 60 votes stupidity.
Once a party wins the majority, I expect them to get do the stuff they promised. If they do stuff that everyone dislikes, they will get voted out and then the other party can do what they want and the cycle will continue.
