    EAD is employment authorization document. Your analogy is like -

    "Can I use her driving licence to drive around town". I am not sure if that is what you meant.

    If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

    Hello IV Gurus,

    Below is my info and kindly let me know your thoughts

    My Current Status: H1B
    EAD start date: 1st Nov 2007 (Didnt start using it yet)
    Occupation Title: Computer Software Enginner
    OES Code: 15-1031

    New Position: Sales Consultant
    For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.

    1. What are the immigration steps that need to be considered for the portability(AC21) ?

    2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?

    Hi,

    Last year my husband got laid off. At that time he was on H1 visa, 140 approved and 485 pending. He applied and got AP, and then left U.S in March 2009. AP is valid until March 02, 2010.

    Now he wants to get back to U.S. and try his luck finding a job before AP expires.

    My question is what are his chances to be able to get in U.S considering

    1)He has stayed outside of U.S for about 11 months.
    2)He is not employed by any U.S company.

    This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

    I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.

    It would be great if I get answer the below my Question:

    1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
    2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

    I have a question on the receipt number. If we get the receipt number, does it mean "The application is accepted" (All the supporting documentation and fee are coorect)?

    or

    Are there any cases where receipt numbers is issued though the supporting documentation / fee is not correct?
    If correct fee is not filed, application will be rejected.

    Same thing happened to my wife's EAD.
    USCIS did a mistake on address (forgot to include apt #) and it was returned undeliverable.
    Called USICS and spoke to IO , she told us that she will order to resend again.
    After 30 days still not received.
    Called again USCIS, this time they opened a Service Request and asked us wait for another 25 days.
    I am not sure what can we do about it.
    We have received all receipts and AP.
    It would creat problem if somebody has job waiting and they don't have EAD.

    are there any approvals from TSC lately ? since the online status is down, there is no way to get status updates now. Worse yet we don't get notifications on RFE's and if the lawyer did not notify on time, this is going to be a disaster..

    I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.

    Hi,

    I am in the same situation, I called my lawyer and he mentioned that there is no problem legally, but the issue is incase they need some clarification from you and you are not in US then it would be an issue as the time frame is very short.

    I am going to canada for my stamping, so he said it might not be an issue.

    What format are you saving images in? As I understand from what I've been told (I've shot with a D70, D1, and D200, but not a D100), the D100 can be quite a pain to use with compressed RAW, as it becomes very slow; are you sure the settings haven't somehow gotten changed to use RAW compression?

    My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.

    What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??

    Your friend and his co-worker has to find another job in same/similar field as soon as possible and file AC21 with the new employer.

    In 2004, a friend moved within the same Multinational company (A) from one business (A1) to another (A2). The HR department did not apply for an H1 transfer assuming that one was not needed, and the friend worked for a few months before the business A2 was sold off, and the new company realized the mistake, and filed for her H1 transfer, which was approved. The new company then filed for her labor and got her I-140 approved.

    Can the friend now file for AOS? Was the period that she worked for A2 'unauthorized'? Does that preclude her from adjusting her status now?

    I am guessing that a lot of employers/people might have made similar mistakes through no faults of their own. Whats the solution here?

    I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.

    Can anyone please help me with below queries
    1. Do i need Original petetion from previous employer for Green Card processing ?.
    2 Should i return H1 petetion or not to my previous employer ?.
    2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.

    I would really appreciate and thankful , if you clarify my doubts.

    You can return top part of petition and keep lower part with you. Before giving back just make a noterized copy with you. just in case.
